1. Introduction

WWWS LLC dba EMF Gone ("we," "us," or "our") operates emfgone.com (the "Site"), which is powered by Shopify. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit our Site, purchase our products, or communicate with us — including through email and SMS/text message marketing.

By using the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

Note: This Privacy Policy does not cover the practices of third-party services linked from our Site. We encourage you to review their privacy policies independently.


2. Information We Collect

2.1 Information You Provide Directly

When you place an order, create an account, subscribe to our email or SMS list, or contact us, we may collect:

  • Identity data: First and last name
  • Contact data: Email address, mailing address, phone number
  • Order data: Products purchased, order history, shipping and billing addresses
  • Payment data: Credit/debit card number, billing name and address — processed and stored by Shopify Payments (or another Shopify-supported payment processor). We do not store full card numbers on our servers
  • Communications: Messages, inquiries, or feedback you send us, including replies to SMS or email
  • SMS/text messaging opt-in data: Your mobile phone number and consent status when you opt in to receive text messages from us

2.2 Information Collected Automatically

When you visit the Site, we and our service providers automatically collect:

  • Device and usage data: IP address, browser type and version, operating system, referring URLs, pages viewed, time spent on pages, clickstream data, and device identifiers
  • Cookie data: Data from cookies, pixel tags, and similar tracking technologies (see Section 6), including cookies used to track items placed in — and abandoned from — your shopping cart
  • Location data: General geographic location derived from your IP address (country, state, city — not GPS-level precision). We collect this automatically through your device's connection to the Site and use it to localize pricing/currency and shipping estimates, detect and prevent fraud, and comply with regional legal requirements. We do not collect precise GPS location and do not use location data for location-based advertising.

2.3 Information from Third Parties

We may receive information about you from:

  • Shopify: As the platform that hosts and powers our Site, Shopify processes order, payment, and account data on our behalf (see Section 4.2)
  • Klaviyo: As our email and SMS marketing platform, Klaviyo manages our marketing communications, list subscriptions, and cart-abandonment messaging
  • Analytics providers: Aggregated and anonymized behavioral data from analytics platforms
  • Advertising platforms: Information about ad interactions (e.g., whether you clicked a Facebook or Google ad before visiting)

3. How We Use Your Information

We use the information we collect for the following purposes:

We do not sell your personal information. We share your data only in the following circumstances:

4.1 Service Providers

We share information with vendors who perform services on our behalf, including:

  • Shopify — website hosting, order processing, and payment processing. Shopify's Consumer Privacy Policy applies to data it processes on our behalf: privacy.shopify.com/en
  • Klaviyo — email and SMS marketing automation, including cart-abandonment messaging. Klaviyo's privacy policy applies to data it processes: klaviyo.com/privacy
  • Shipping carriers (e.g., USPS, UPS, FedEx, DHL) — to fulfill and deliver orders
  • Analytics providers (e.g., Google Analytics) — to understand Site usage
  • Advertising platforms (e.g., Meta, Google Ads) — to display relevant advertising

All service providers are contractually required to protect your information and use it only for the services they perform for us.

The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4.2 Relationship with Shopify

Our Site is hosted by Shopify, which collects and processes personal information about your access to and use of the Site in order to provide and improve the Site for you. Information you submit to the Site will be transmitted to and shared with Shopify, as well as third parties Shopify works with, in order to provide and improve the Site for you. In these circumstances, Shopify is responsible for the processing of your personal information for these purposes. Depending on where you live, you may exercise certain rights with respect to your personal information via the Shopify Privacy Portal.

4.3 Legal Requirements

We may disclose your information if required to do so by law or in good-faith belief that such action is necessary to:

  • Comply with a legal obligation, court order, or government request
  • Protect and defend the rights or property of EMF Gone
  • Prevent or investigate possible wrongdoing in connection with the Site
  • Protect the personal safety of users of the Site or the public

4.4 Business Transfers

If EMF Gone is involved in a merger, acquisition, asset sale, or bankruptcy, your personal information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a materially different privacy policy.

4.5 With Your Consent

We may share your information with other third parties when you have given us explicit consent to do so.


5. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

6.5 Do Not Track / Global Privacy Control

Our Site does not currently respond to browser "Do Not Track" signals because no industry-standard interpretation of those signals exists. If you visit our Site with the Global Privacy Control (GPC) opt-out signal enabled, we will treat this as a request to opt out of targeted advertising for the device and browser you use, as described in Section 7. 7. SMS/Text Messaging Communications

7.1 Our Program

If you opt in to receive text messages from us (e.g., order updates, shipping notifications, cart-abandonment reminders, or promotional offers), we collect your mobile phone number and your consent status. We use this information solely to:

  • Send transactional messages (order confirmations, shipping updates)
  • Send cart-abandonment reminder messages, using the cookie-based tracking described in Section 6.2
  • Send promotional and marketing messages, where you have consented to receive them

Text messaging originator opt-in data and consent are shared only with our SMS service provider (Klaviyo) to the extent necessary to deliver these messages. This data is not shared with any other third parties, and it is excluded from the third-party data sharing described in Section 4.

7.2 Opting Out

You can opt out of text messages at any time by replying "STOP" to any message you receive from us, or by contacting us using the details in Section 11. Message and data rates may apply. Message frequency varies.


8. Your Privacy Rights

8.1 All Users

Regardless of your location, you may:

  • Opt out of marketing emails and text messages at any time by clicking "Unsubscribe" in any email or replying "STOP" to any text message we send, or by emailing us at the address in Section 11. We will process opt-out requests within 10 business days.
  • Update or correct your account information by logging into your account or contacting us.
  • Access, delete, correct, or port your personal information, and opt out of the sale or sharing of your personal information for targeted advertising, as described further below. You can also exercise this opt-out right here.

8.2 California Residents (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA):

  • Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the third parties with whom we share it.
  • Right to Delete: Request deletion of personal information we have collected about you (subject to certain exceptions, including retention required by law).
  • Right to Correct: Request correction of inaccurate personal information.
  • Right to Opt Out of Sale or Sharing: We do not sell your personal information. We do share data with advertising partners in ways that may constitute "sharing" under CPRA. To opt out of this sharing, contact us or use the Global Privacy Control (GPC) signal in your browser. This opt-out right does not apply to text messaging originator opt-in data and consent, which we do not share with any third parties.
  • Right to Limit Use of Sensitive Personal Information: We do not use sensitive personal information for purposes beyond those permitted by law.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

To submit a CCPA/CPRA request, email us at the address in Section 11 with the subject line "California Privacy Request." We will verify your identity before processing and will respond within 45 days (extendable by an additional 45 days with notice).

Authorized Agents: California residents may designate an authorized agent to submit requests on their behalf by providing written authorization or a power of attorney.

8.3 Nevada Residents

Nevada residents may request that we not sell their personal information. We do not sell personal information. To submit a request nonetheless, contact us at the address in Section 11.

8.4 International Users (EEA, UK, Canada)

If you are located in the European Economic Area, United Kingdom, or Canada, you may have additional rights under applicable data protection law (e.g., GDPR, UK GDPR, PIPEDA), including:

  • Right of access to your personal data
  • Right to rectification
  • Right to erasure ("right to be forgotten")
  • Right to restriction of processing
  • Right to data portability
  • Right to object to processing based on legitimate interests
  • Right to withdraw consent at any time (where processing is consent-based)
  • Right to lodge a complaint with your local supervisory authority

If we transfer your personal information out of the European Economic Area or the United Kingdom, we will rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses, or equivalent mechanisms issued by the relevant competent UK authority, unless the transfer is to a country determined to provide an adequate level of protection.

8.5 Exercising Your Rights

You may exercise any of these rights where indicated on the Site or by contacting us using the details in Section 11. We may need to verify your identity before processing your request, as permitted or required under applicable law. We will not discriminate against you for exercising any of these rights.


9. Data Security

We implement commercially reasonable technical and organizational measures to protect your personal information, including:

  • SSL/TLS encryption for all data transmitted between your browser and our Site
  • Shopify's PCI-DSS compliant payment processing infrastructure
  • Access controls limiting employee access to personal information to those who need it to perform their job
  • Regular security review of our systems and practices

No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. In the event of a data breach that is likely to result in a high risk to your rights, we will notify you as required by applicable law.


10. Children's Privacy

Our Site is not directed to children under the age of 13 (or 16 where required by applicable law), and we do not knowingly collect personal information from children. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" personal information of individuals under 16 years of age. If we learn that we have inadvertently collected information from a child, we will delete it promptly. If you believe we have collected information from a child, please contact us immediately at the address in Section 11.


11. Health and Medical Disclaimer Notice

EMF GONE is a Quantum Resonant Formula. We may collect general wellness information you voluntarily provide (e.g., in a customer survey or support inquiry). We treat any health-related information you provide with heightened care and will not use it for marketing purposes without your explicit consent.

Adverse Event Reporting: If you experience an adverse health event that you believe may be related to our product, please contact us immediately. Federal law (21 U.S.C. § 379aa-1) requires us to report serious adverse events to the FDA, which may involve limited disclosure of your information to the FDA. We will handle such disclosures as required by law.
